In Consideration of Cross Timbers, a Texas unincorporated not-for-profit Association, permitting me to engage in their
firearms-shooting activities of that Association, I, on my own behalf and on the behalf of my heirs, representatives,
administrators and assigns, hereby waive and release any and all claims, demands, causes of action suits and rights I, or anyone acting on my behalf, might have against that Association, its officers and/or directors for personal injury,
including death, loss or damage to my property, which I (or anyone claiming by or through me) may have against that Association and its officers and/or directors.
Further, and in consideration of Cross Timbers permitting me to engage in their firearms-shooting activities, I expressly contract that I will not, nor will anyone acting on my behalf claiming by or through me, bring or maintain any suit in Court to assert any claim against that Association, its officers and/or directors that I might have arising out of my participation.
I understand that engaging in firearms shooting activities involves a very hazardous and dangerous activity with accompanying risks of personal injury or death and loss or damage to personal property, and I HEREBY
VOLUNTARILY ASSUME THOSE RISKS.
I am aware of risks and hazards connected with being on the premises and participating in
firearms-shooting activities of the Association, and I am fully aware that there may be risks and hazards unknown to me connected with being on the premises and participating in these activities, and I hereby elect to voluntarily participate and or observe in the events, to enter upon the premises and engage in activities knowing that conditions may be hazardous, or may become hazardous or dangerous to me and my property. I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of my being a participant in these activities, whether caused by the negligence of releases or otherwise.
Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by
arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The
number of arbitrators shall be three. The place of arbitration shall be Fort Worth, Texas. Texas law shall apply.
Judgment on the award rendered by the arbitrators may be entered in any court having jurisdiction thereof.
All attorney’s fees will be paid by the party initiating suit. Any right to a jury trial is hereby waived.
I have read and understand the foregoing provisions of this Waiver, Release and Covenant Not to Sue and I have
executed this instrument voluntarily on this date.
I recognize that the Association, its officers and/or directors are not obligated to permit me to participate in any of the
Associations activities and may terminate my participation in such activities at any time and for any reason.
This instrument shall not preclude the prosecution of any claim that I might have against persons or entities other than
Cross Timbers and/or its officers and/or directors. In other words, I am releasing, waiving my rights, and agreeing not to sue Cross Timbers, CTASA, its officers, and/or directors at any time for any reason.
This instrument shall remain in full force and effect indefinitely.
I am Twenty-One (21) years of age or older, or I am the parent or legal guardian on the undersigned.
